1. Introduction

Cuvanti (“Company,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our website, web applications, mobile applications, APIs, and related services (collectively, the “Service”).

This policy applies to all users of the Service, including property managers, landlords, tenants, property owners, vendors, and visitors. By using the Service, you consent to the practices described in this Privacy Policy.

Important Note on Data Roles. When property managers use Cuvanti to manage tenant data, the property manager acts as the data controller and Cuvanti acts as a data processor. If you are a tenant, owner, or vendor using a portal provided through Cuvanti, your property manager determines how your data is used. Please refer to your property manager's privacy policy for additional details.

2. Information We Collect

Information You Provide Directly. When you create an account, submit forms, or use the Service, we may collect:

  • Name, email address, phone number, and mailing address
  • Government-issued identification (for tenant screening and identity verification)
  • Financial information (bank account details, payment card information processed via third-party payment processors)
  • Employment history, income information, and rental history (for rental applications)
  • Property information (addresses, unit details, lease terms, listing descriptions, photos)
  • Maintenance request details, including descriptions and uploaded photos
  • Communications sent through the platform (messages, notes, comments)

Information Collected Automatically. When you access the Service, we automatically collect:

  • Device information (device type, operating system, browser type and version)
  • IP address and approximate geolocation
  • Usage data (pages viewed, features used, actions taken, timestamps)
  • Cookies and similar tracking technologies (see Section 7)

Information from Third Parties. We may receive information from:

  • Consumer reporting agencies (credit reports, criminal background checks, eviction history) for tenant screening
  • Public records and property databases
  • Third-party integrations and services you connect to your account
  • Property managers (if you are a tenant, owner, or vendor using a portal)

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service, including account management, property management, and transaction processing
  • Process rent payments, owner disbursements, and other financial transactions
  • Facilitate tenant screening and background checks through authorized third-party providers
  • Route and track maintenance requests between tenants, property managers, and vendors
  • Syndicate property listings to third-party rental and real estate platforms
  • Enable communication between landlords, tenants, vendors, and other users
  • Power AI-driven features, including automated issue categorization, communication drafting, and analytics
  • Verify identity, prevent fraud, and maintain the security of the Service
  • Improve the Service through analytics, product development, and aggregated benchmarking
  • Send transactional communications (payment confirmations, maintenance updates, lease notifications) and, with your consent, marketing and promotional messages
  • Comply with legal obligations, including tax reporting (e.g., 1099 filings) and regulatory requirements

4. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • With Property Managers and Portal Users. Tenant, owner, and vendor data is shared with the property manager who manages the related property, and vice versa, as necessary to provide the Service.
  • With Service Providers. We share data with third-party vendors who assist in operating the Service, including cloud hosting providers, payment processors, email delivery services, consumer reporting agencies, and analytics providers. These providers are contractually obligated to use your data only as necessary to perform services on our behalf.
  • With Credit Bureaus. If you opt into rent reporting, your rental payment history may be reported to credit bureaus.
  • For Legal Compliance. We may disclose information in response to subpoenas, court orders, or other legal process, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
  • In Corporate Transactions. If Cuvanti is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.
  • Aggregated and Anonymized Data. We may share aggregated, de-identified data for industry research, benchmarking, and product improvement purposes. This data cannot be used to identify you.

5. Property-Management-Specific Data Handling

Tenant and Applicant Data. Screening reports, credit history, criminal background data, and eviction history are obtained from consumer reporting agencies and handled in accordance with the Fair Credit Reporting Act (FCRA). This data is provided to the requesting property manager and is not used by Cuvanti for any other purpose.

Financial Data. Rent payments, security deposits, and owner disbursements are processed through PCI-compliant third-party payment processors. Cuvanti does not store full payment card numbers on its servers.

Maintenance Request Data. Work order details, photos, vendor assignments, and completion records are stored and shared between relevant parties (tenants, property managers, and assigned vendors) to facilitate maintenance resolution.

Property Listing Data. Property addresses, photos, unit details, pricing, and availability information may be syndicated to third-party listing platforms in accordance with your account settings.

Lease and Document Data. Electronic lease documents, e-signatures, and inspection records are stored securely and accessible to authorized parties.

6. AI Features and Data

Cuvanti uses artificial intelligence to power features including automated maintenance categorization, communication drafting, analytics, and workflow automation. When you use AI-powered features, the content you provide (such as maintenance descriptions, messages, or property data) may be processed by our AI systems or third-party AI providers to generate responses and insights.

We do not use your personal data to train general-purpose AI models. AI processing is performed to deliver the requested feature functionality. You may opt out of AI-powered features through your account settings where applicable.

7. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Service, remember your preferences, analyze usage, and improve performance. The types of cookies we use include:

  • Essential Cookies. Required for the Service to function (authentication, security, session management).
  • Functional Cookies. Remember your preferences and settings to enhance your experience.
  • Analytics Cookies. Help us understand how users interact with the Service so we can improve it.

You can manage cookie preferences through your browser settings. Disabling certain cookies may affect the functionality of the Service.

8. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. After account closure, we may retain certain data for a reasonable period to comply with legal obligations, resolve disputes, enforce our agreements, and support legitimate business operations.

Tenant screening reports are retained only as long as required by applicable law and the terms of our agreements with consumer reporting agencies. Financial transaction records are retained in accordance with tax and regulatory requirements.

You may request deletion of your personal data at any time, subject to legal retention requirements (see Section 10).

9. Data Security

We implement industry-standard technical and organizational safeguards to protect your personal information, including:

  • Encryption of data in transit (TLS/SSL) and at rest
  • Access controls and role-based permissions
  • Regular security assessments and monitoring
  • Employee training on data protection practices
  • Secure cloud infrastructure with redundancy and backups

While we take reasonable measures to protect your data, no system is completely secure. We cannot guarantee absolute security and are not liable for unauthorized access resulting from circumstances beyond our reasonable control.

10. Your Rights and Choices

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Access. Request a copy of the personal information we hold about you.
  • Correction. Request correction of inaccurate or incomplete personal information.
  • Deletion. Request deletion of your personal information, subject to legal exceptions.
  • Portability. Request a copy of your data in a structured, machine-readable format.
  • Opt-Out. Opt out of marketing communications at any time by following the unsubscribe link in any email or adjusting your notification settings.
  • Withdraw Consent. Where processing is based on consent, you may withdraw it at any time.

11. State-Specific Privacy Rights

California Residents (CCPA/CPRA). If you are a California resident, you have the right to: (a) know what personal information we collect and how it is used; (b) request deletion of your personal information; (c) opt out of the “sale” or “sharing” of personal information (Cuvanti does not sell personal information); and (d) not be discriminated against for exercising your rights. You may designate an authorized agent to submit requests on your behalf.

Other U.S. State Privacy Laws. Residents of Virginia, Colorado, Connecticut, and other states with comprehensive privacy laws may have additional rights, including the right to access, correct, delete, and obtain a portable copy of personal data, and the right to opt out of targeted advertising and profiling. To exercise these rights, contact us using the information provided in Section 15.

12. Children’s Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete it promptly. If you believe a child has provided us with personal information, please contact us.

13. SMS and Text Messaging

If you opt in to receive text messages from the Service, we may send you notifications related to maintenance requests, payment reminders, lease updates, and account security. Message and data rates may apply. You can opt out at any time by replying STOP to any message or adjusting your notification preferences in your account settings.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. For material changes, we will notify you via email or an in-app notification at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated policy. We encourage you to review this page periodically.
