The Badenoch and Strathspey control area has been applied on the basis that this property is in Ward 20 of the Highland Council area. A ward boundary cannot be resolved from an address alone. If the property is elsewhere in Highland, no control area applies to it today and only the Scotland-wide licensing binds.
Was das in der Praxis bedeutet
Diese Hinweise sind je Ort verfasst und liegen derzeit nur auf Englisch vor.
- A short-term let licence from the local authority is MANDATORY in Scotland. Licensing began in October 2022 and every operating property has needed a licence since 1 January 2025.
- Operating without a licence is a CRIMINAL offence, with fines up to GBP 2,500. This is not a civil penalty and it is the most serious consequence in any market Cuvanti covers.
- Licence conditions cover safety, insurance and maximum occupancy, and are set by the local authority. Some areas also operate short-term let control zones where planning permission is separately required.
- The WHOLE of Ward 20, Badenoch and Strathspey, became a short-term let control area at 12 noon on 4 March 2024. It covers Aviemore, Carrbridge, Boat of Garten, Dalwhinnie, Grantown-on-Spey, Kingussie and Newtonmore.
- A control area is NOT a ban on short-term letting. What it does is make PLANNING PERMISSION always required for the change of use of a dwellinghouse that is not your only or principal home into a short-term let. That is secondary letting, and it is the second property let whole that the control area catches.
- Planning permission may be needed BEFORE you apply for your licence, so take them in that order rather than discovering it at the licensing stage.
- Applications are determined against the Council's adopted Development Plan and its non-statutory Short-Term Let Control Area Planning Policy, and neighbours have the right to make representations.
- No visitor levy applies here today, unlike Edinburgh.
