- New York City prohibits letting an entire apartment or home for fewer than 30 consecutive days. That holds even if you own the building. It is a ban on a mode of letting, not a limit on nights, so there is no number of nights that makes a whole-unit short let lawful.
- What is permitted is a registered host letting space within the dwelling unit they permanently occupy. You must stay in the same unit as your guests, there may be no more than two guests at a time, and every guest must have access to all parts of the unit and to each exit. Internal doors may not be locked against them.
- Registration with the Mayor's Office of Special Enforcement is required before you list, under Local Law 18 of 2022. The application fee is US$145 and is not refundable. Booking platforms are barred from processing a transaction for an unregistered unit, so an unregistered listing does not merely risk a penalty, it cannot take a booking.
- Your short-term rental registration number must appear in every advertisement, and the registration certificate and an egress diagram must be posted inside the unit during each stay.
- You must keep a record of every short-term rental for at least seven years and produce it to the agency on request.
- Registration is refused for rent-stabilised, rent-controlled and other rent-regulated units, for New York City Housing Authority apartments, for rooming units, and for any address on the city's prohibited buildings list, which building owners can ask to join.
- Stays of 30 consecutive days or more are outside the registration law altogether. So are Class B multiple dwellings, which are the only buildings in the city where entire-unit short letting is lawful.
- Letting without a valid registration carries a civil penalty of the lesser of US$5,000 or three times the revenue from the rental, per violation. A registered host who breaches the chapter faces up to US$5,000 per violation, a false statement on an application up to US$1,000, and three violations in 24 months revokes the registration.
